The Paulini Model of Legal Negotiation: A Structural Framework for Professional Negotiation
Abstract
Legal negotiation is commonly understood as an exchange of legal arguments. In practice, many conversations are decided not by the strength of legal positions but by the parties' capacity to recognise and manage complex social and psychological dynamics. This article introduces the Paulini Model of Legal Negotiation, a conceptual framework for professional negotiation in legal contexts. The model rests on three levels: legal clarity, psychological understanding, and the negotiator's personal stance. Legal clarity provides orientation within the normative frame. Psychological understanding enables realistic assessment of perceptions, emotions, and interests. The negotiator's stance determines whether structured conversation remains possible under pressure. The Chain of Clarity describes how cognitive clarity is converted into practical conduct.
