Searching for guidance: Supreme Court cases carry implications for on‐campus searches

Abstract

Every year, colleges and universities confront questions about searching students’ or employees’ possessions, living spaces, and work areas. On large campuses, these questions arise routinely. On small private campuses, they may surface only occasionally — but often in serious situations. Two recent U.S. Supreme Court decisions offer a useful lens for thinking about how institutions should respond.
