The Democratization of Legal Analysis Not Yet Affordable: Affordability as the Upstream Gate that Precedes Trust
Abstract
This work places affordability as the upstream gate of the AI-assisted democratization of legal analysis. A companion work in the same field, The Democratization of Legal Analysis Not Yet Complete, separates three layers: access to documents, the capacity to work them into a deep diagnosis, and trust in the result; it then locates the incompleteness at the layer of trust and shifts trust from lineage to audit. This work shows that a further gate stands even further upstream, and that it has been conceded too quickly: available capacity is not affordable capacity. It distinguishes availability from affordability; it shows why capacity-at-depth will not be democratized in the way document-access was, because the latter carries zero marginal cost and the former never does; it lays out a ladder drawn from the logic of the examinability of the work — the cost walls off production, not verification — together with that ladder’s partialness, acknowledged plainly; and it then demonstrates that wall closing at the author’s own desk. The work closes by tying itself to the same nerve as its companion works: a claim names the conditions on which it stands, rather than disguising them.
