Cross-Border Consumer Debt Enforcement and Evidentiary Accountability: Supplementary Research Dossier
Abstract
Abstract This supplementary research dossier examines evidentiary accountability and regulatory oversight in cross-border consumer-debt enforcement within the European Union, focusing on Latvian civil proceedings involving an Estonian assignee, Aktiva Finance Group OÜ. The research analyses the documentary chronology of a Latvian judgment delivered on 10 July 2026, subsequent enforcement accounting, creditworthiness assessments, the assignment of receivables, electronic contracting evidence, and access to personal data under the General Data Protection Regulation. Particular attention is given to correspondence from the Estonian Financial Supervision Authority (Finantsinspektsioon), which confirmed that the company held no authorisations issued by that authority while expressly leaving unresolved whether authorisation was legally required for the specific activities concerned. The dossier identifies questions requiring further documentary verification, including differences in reported loan disbursement totals, the evidentiary relationship between a 2012 registration payment and a 2022 credit agreement, and the reconciliation of post-judgment enforcement amounts. The publication includes an evidence matrix, supervisory correspondence analysis, research limitations, and an accompanying documentary case study. Research integrity statement: This is independent, non-peer-reviewed legal research based on a single case. The author was a party to the underlying proceedings. The publication does not establish regulatory misconduct, criminal liability, or judicial wrongdoing. Its purpose is to promote transparent, reproducible legal analysis and evidence-based discussion of effective judicial protection within the European Union.
