TRUMPIN-PUTRUM GESTALT, THE ICC IS LAZARUS, UKRAINE'S JUDICIAL SELF-REPRESENTATION

Abstract

Scientific Description This publication brings together two scientific research annexes and the accompanying correspondence addressed to President Volodymyr Zelenskyy on 10 October 2026. The subscript operator ₒ identifies a term used within the research's configurative and referential reading framework. It invites the reader to distinguish the term's specific scientific function from its ordinary-language meaning. The explanatory parentheses specify that function in the present research context. Annex XXI-F — TRUMPIN–PUTRUMₒ (the research designation for a potentially hybrid configuration involving Trump–Putin relations, peace diplomacy and measures relevant to Russia's war-sustaining capacities) examines the reported American authorisation concerning transactions involving Russian-origin diesel. The investigation begins with the empirically encountered GESTALTₒ (the configuration of relations, positions and actions encountered in the field) and develops its GESTALTGRAMMARₒ (the interpretative grammar through which that configuration becomes scientifically readable). Annex XXI-G — THE ICC IS LAZARUS investigates Ukraine's judicial self-representation and the institutional capacities of the International Criminal Court. The Lazarus narrative provides a referential framework for distinguishing institutional pressure from the continued availability of independent judicial capacity. The annex examines Ukraine's position as a State Party to the Rome Statute, the existing ICC investigation concerning Ukraine and the possibility of timely engagement by competent authorities. Together, the annexes develop a movement from EMPIRICAL FINDINGₒ (identification of encountered facts and relations) through CONFIGURATIVE READABILITYₒ (scientific articulation of their relations and possible significance) toward JUDICIAL ENGAGEMENTₒ (the activation of available judicial capacities from their assigned institutional positions) and possible INSTITUTIONAL ACTIONₒ (a concrete measure taken within the competence of the responsible institution). The research further employs the following concepts: CAPTUREₒ (the phenomenologically observable process through which a position's own grammar becomes organised by forces or relations encountered within the configuration), making visible possible participation in an adversarial grammar without presuming guilt. DIALOGUEₒ (an exchange in which positions may become mutually dependent upon the grammar of the encounter). ENDOLOGUEₒ (a movement of discernment and answer from within one's own responsible position, preserving independent engagement). AFWEERₒ (a repulsive or reactive movement in relation to an encountered threat). VERWEERₒ (the capacity to act responsibly and independently from one's own position). INTERIMINTERVALₒ (the interval during which timely preventive or protective action remains available). HOPEₒ (acting from assigned competence while the outcome remains unseen). DIALOGICAL CIRCULARITYₒ (the self-reinforcing circulation of positions within a shared dialogical grammar, whereby each response may reproduce the configuration from which it seeks to escape). The concept makes readable how dialogical dependency can sustain an encountered configuration and why an independent third referential position becomes relevant. ENDOLOGICAL GRACESₒ (possibilities and transformative developments that become available through responsible engagement from within one's own position, while their occurrence and outcome remain open). The concept expresses the relationship between the responsible activation of available capacities and the developments that may emerge through such engagement. IS & IS NOT CIRCULARITYₒ (the circularity in which a position is alternately affirmed as IS and negated as IS NOT within the same referential grammar, while the opposition continues to reproduce the existing configuration). DIALOGICAL IS & IS NOTₒ (the dialogical movement in which affirmation and negation continually evoke one another, keeping the positions involved bound to the same grammar). These concepts are developed under ZORGVERANTWOORDING (CARE ACCOUNTABILITY), which concerns the responsible activation of available capacities in relation to encountered vulnerabilities and risks. The accompanying correspondence documents the communication of these research findings to the Ukrainian presidency and an invitation to consider the available judicial route.
