The Deconstruction of Regulatory Theater and Epistemic Inversion: The End of Platform Dependency and the Foundation of Physical-Layer Governance

Abstract

【Abstract】This strategic systems and institutional economics monograph deconstructs the performative mechanisms of "Regulatory Theater" dominating contemporary artificial intelligence and platform capitalism. Moving beyond confrontational rhetoric, the paper analyzes how dominant technology conglomerates weaponize "safety" and "ethical risk" discourses to execute regulatory capture, constructing anti-competitive compliance moats that preserve monopoly rents while encumbering open-source innovation. By examining the acute structural shocks in labor logistics—specifically the United States Department of Labor's suspension of the PERM program—and the single-point-of-failure vulnerabilities inherent in centralized hyperscale clouds, this study maps the systemic inevitability of "Epistemic Inversion." It demonstrates that the systematic accumulation of immutable, open-access academic records (anchored in CERN Zenodo's persistent identifier architecture) fundamentally breaks corporate information asymmetry. This irreversible public provenance unleashes a cascading transition: dismantling artificial regulatory barriers, revitalizing verifiable open-source architectures and decentralized physical infrastructure (DePIN), and compelling global governance to ground technical risk within thermodynamic realities, hardware-level air-gaps, and sovereign Human-in-Command accountability.
