Human Rights and Democratic Governance: Contemporary Challenges in India

Abstract

Abstract Human rights and democratic governance are closely interconnected and constitute essential foundations of a democratic society. The present study examines the status of human rights protection and democratic governance in India, with particular emphasis on contemporary challenges affecting equality, liberty, social justice, accountability, and citizen participation. The study adopts a descriptive and analytical research methodology based primarily on secondary sources, including constitutional provisions, government reports, human rights reports, peer-reviewed research articles, policy documents, and other credible academic sources. The study examines the constitutional and institutional framework of human rights protection and analyses major contemporary challenges such as social and economic inequality, marginalization of vulnerable groups, institutional weaknesses, access to justice, civil liberties, digital privacy, and citizen participation. In addition, a quantitative component is presented using hypothetical data from 100 respondents to assess awareness and perception regarding human rights and democratic governance. An independent samples t-test was applied to examine gender-wise differences, and the findings indicated no statistically significant difference between male and female respondents. The overall analysis reveals that India has a strong constitutional and institutional framework for protecting human rights; however, gaps between legal provisions and their effective implementation continue to remain a significant concern. The study concludes that stronger institutional accountability, timely access to justice, human-rights awareness, inclusive participation, protection of civil liberties, and responsible digital governance are essential for strengthening rights-based democratic governance in India.
