Abstract

Abstract The Bharatiya Nyaya Sanhita, 2023 represents a significant reform of India’s criminal law framework, aimed at modernizing the legal system and responding to contemporary forms of crime. This article provides an overview of the major legal reforms introduced by the Sanhita, with particular attention to protections for women and vulnerable groups, expanded definitions of sexual offences, new offences relating to cybercrime, mob lynching, identity theft, fraud and hate speech, and enhanced punishments for serious crimes. It also examines the emphasis on gender-neutral language, aggravated offences against women, victim support and rehabilitation, and procedural efficiency. The article highlights the objectives of inclusivity, deterrence, human rights and effective justice reflected in the reforms. It also notes challenges relating to implementation, possible ambiguities and the need for continuing legal development and stakeholder participation. Overall, the BNS, 2023 is presented as an important step towards a more responsive, equitable and effective criminal justice system in India.
