Federalism And Cooperative Governance in India: Constitutional Challenges and Opportunities

Abstract

Abstract: Federalism is an important feature of the Indian Constitution. It establishes a constitutional division of powers between the Union and the States while also creating mechanisms for cooperation between them. Unlike classical federations, the Indian Constitution provides a strong Union Government to maintain national unity, security and economic stability. At the same time, States have substantial constitutional responsibilities in areas such as public order, public health, agriculture and local administration. In recent years, the relationship between the Union and the States has become increasingly important because many national challenges require coordinated action. Issues such as public health, environmental protection, economic development, taxation, disaster management, digital governance and internal security cannot always be addressed effectively by one level of government alone. The concept of cooperative federalism therefore assumes considerable significance. This paper examines the constitutional framework of Indian federalism and analyses the opportunities and challenges associated with cooperative governance. It discusses the distribution of legislative, administrative and financial powers, the role of institutions such as the Inter-State Council, Finance Commission and GST Council, and the contribution of the Supreme Court in protecting the federal character of the Constitution. The paper argues that Indian federalism should not be understood merely as a division of powers but as a continuing constitutional partnership between different levels of government. Strengthening consultation, fiscal autonomy, institutional dialogue and constitutional conventions can make cooperative federalism more effective.
