Effective Judicial Protection in Property Tax Administration: Legal Certainty, Reasoned Decisions and Access to an Effective Remedy in Latvia
Abstract
This independent legal study examines the requirements of legal certainty, reasoned administrative decision-making and effective judicial protection in the context of immovable property tax administration in Latvia. The analysis is based on a documented administrative matter concerning the immovable property “Brodi”, Rugāji Parish, cadastral number 3874-014-0022, and considers the practical ability of an individual to understand, verify and effectively challenge a public-law financial obligation. The study examines the interaction between Latvian law and the requirements arising from the Constitution of the Republic of Latvia (Satversme), the Charter of Fundamental Rights of the European Union, and general principles of effective judicial protection. Particular attention is given to legal certainty, adequate reasoning, proportionality, access to information necessary for challenging an administrative measure, and the practical effectiveness of available remedies. The publication distinguishes between the formal existence of legal remedies and their practical accessibility to an ordinary property owner or agricultural operator. It considers whether administrative and judicial procedures provide sufficiently clear and effective mechanisms for understanding and contesting a financial obligation imposed by a public authority.
