Effective Judicial Protection and Irreversible Property Enforcement in Latvia: A Documented Legal Case Study of the Judicial Sale of the Immovable Property "Brodi"

Abstract

AbstractThis 25-page legal study examines the availability and effectiveness of judicial protection in the context of the judicial sale of the immovable property “Brodi” in Latvia. The analysis is based on primary legal and procedural documents concerning the auction process, a constitutional complaint challenging the relevant procedural framework, and the subsequent response of the Constitutional Court of the Republic of Latvia. The study focuses on the interaction between the right to a fair court and effective judicial protection, the protection of property rights, the non-appealability of certain judicial decisions, the requirement of proportionality, and the particular importance of preventive judicial protection where enforcement measures may produce irreversible legal consequences. Particular attention is given to Articles 92 and 105 of the Constitution of the Republic of Latvia (Satversme), Article 6 of the European Convention on Human Rights and Article 1 of Protocol No. 1. The study also addresses the limits of relying upon Article 47 of the Charter of Fundamental Rights of the European Union, which requires an identifiable connection with the implementation or application of European Union law. The publication distinguishes between documentary facts, allegations made in procedural submissions, and independent legal analysis. It does not characterize an alleged violation as an adjudicated fact where the underlying documents do not establish such a finding. Length: 25 pages.
