The Asymmetric Velocity of Intellectual Property: A Dual-Track Framework for Frontier Systems and Legacy Institutions
Abstract
Traditional intellectual property (IP) institutions—specifically national patent offices and peer-reviewedacademic journals—were designed around the capital cycles and technological velocities of the IndustrialEra. Today, at the technological frontier (e.g., generative artificial intelligence, autonomous softwareengineering, and rapid-iteration protocols), product lifecycles are measured in weeks, rendering multi-yearadministrative evaluation cycles structurally obsolete. This paper introduces the Dual-Track IP GovernanceFramework, asserting that modern intellectual property has fundamentally bifurcated rather than merelyaccelerated. We demonstrate why attempting to reform legacy review bodies to match frontier speeds isimpossible. Instead, the knowledge economy operates across two parallel paradigms: (1) The FrontierRealm, governed by execution velocity, open-source validation, preprints, defensive publication, andstrategic chokepoint positioning; and (2) The Legacy Realm, where statutory monopolies and retrospectivecredentialing remain essential for high-CapEx, safety-critical domains. Furthermore, we analyze the survivalmechanics of resource-constrained pioneers who leverage zero-fixed-cost architectures and infrastructurepiggybacking to capture future technological tollgates.
