The Structural Scarcity of Materialized Justice

Abstract

This paper argues that the scarcity of materialized justice is not a contingent failure of implementation but a structural regularity. We operationalize justice as materialized justice —completed State action producing a binding legal determination — enabling empirical measurement across legal systems. Through one philosophical and definitional proposition, three definitional propositions, and three falsifiable propositions, I demonstrate that from rule systems emerge right and wrong, justice and injustice; legal systems—State rule systems—employ the terminology 'legal/illegal' for what constitutes right/wrong within their jurisdiction. We introduce a conceptual distinction between intra-systemic justice (the State's capacity to adequately investigate alleged violations, judge whether violations actually occurred, and execute punishment according to its own established rules) and materialized justice (completed State action producing a binding legal determination), demonstrating their empirical independence—high intra-systemic justice does not guarantee high materialized justice. Since materialization requires finite agents deploying scarce resources in response to alleged violations, and since alleged rule violations create diffuse demand while justice materialization remains centralized, a fundamental asymmetry renders universal justice materialization structurally unachievable. Critically, systems with high intra-systemic justice (thorough investigation, rigorous judgment, adequate punishment execution when alleged violations enter the system) do not guarantee high materialization rates—Denmark, Norway, and Finland, the world's highest-scoring systems on Rule of Law, still exhibit substantial materialization scarcity. The analysis shows that materialization scarcity is a plausible and consistent structural pattern.
